California Appeals Court Strikes Down Long Gun Waiting Period Extension
Ruling says state failed to justify additional delays for lawful purchasers

On August 8, 2025, the California Third District Court of Appeal struck down a 2023 amendment that extended the states waiting period for long gun purchases from 10 to 15 days. The court found that the state had not provided sufficient evidence that the additional delay improved public safety or reduced gun violence. The lawsuit, brought by several gun owners and supported by the California Rifle & Pistol Association, argued that the extension violated the Second Amendment rights of lawful buyers who had already passed background checks. Californias Attorney General has not yet announced whether the state will appeal to the California Supreme Court.
