Circuit Judge Sandra Ikuta wrote that California failed to show the law aligned with the nations historical tradition of firearm regulation, concluding it infringed on the right to keep and bear arms. The law, passed by voters in 2016, had been challenged in Rhode v. Bonta. While a district court initially enjoined the law in 2020, an appellate stay allowed it to remain in effect until this latest ruling. Governor Gavin Newsom criticized the decision as undermining public safety, while gun rights advocates hailed it as a major win. Despite the ruling, the California Department of Justice has stated that background checks for ammunition remain in effect until procedural stepssuch as issuing the courts mandateare completed. Dealers and purchasers are advised to continue following current requirements until further notice.
