Federal court halts Delaware's new assault weapon law
Federal Court Puts Temporary Hold on Delaware Assault Weapons Ban
📅
✍️By ZRIntel Editorial Team📍Wilmington, DelawareA federal judge has issued a temporary injunction against Delawares recently passed assault weapons ban, putting enforcement on hold as litigation moves forward. The law, enacted earlier this year, sought to restrict the sale and possession of commonly owned semi-automatic rifles and high-capacity magazines. Pro-Second Amendment groups, including the Firearms Policy Coalition and Delaware State Sportsmen's Association, filed suit arguing the law violates constitutional protections under the Bruen standard. In his ruling, U.S. District Judge Gerald Simms stated that plaintiffs had shown a strong likelihood of success on the merits and that the state failed to demonstrate historical analogues justifying the restrictions. The injunction halts enforcement of the ban until a full trial determines its legality. Delaware Attorney General Kathy Jennings expressed disappointment in the ruling but vowed to defend the law vigorously.
