Leopoldo Gutierrez, 25, of Lehi, was booked into the Utah County Jail on Monday night for investigation of two counts of attempted murder, causing a riot, 18 counts of discharge of a firearm, criminal mischief, disorderly conduct, and illegal gun possession.
Utah County sheriff’s deputies were dispatched on December 23 to a reported fatal drive-by shooting in the area of Wild Horse Way and Morgan Way in Eagle Mountain, where a 23-year-old male received a gunshot wound to the neck. As of Tuesday, the sheriff’s office reported that the 23-year-old victim remained hospitalized and was making improvements.
Detectives investigating the shooting uncovered that a juvenile had been involved in a fight with another person earlier that day. After the altercation, the juvenile allegedly made threats on social media to kill the other individual. Later that evening, the boy approached the other's residence around 8 p.m. The 23-year-old victim, another male, and his girlfriend went outside to confront the juvenile.
As tensions escalated, the juvenile ran behind a parked car, where an individual inside a dark four-door sedan fired shots at the victim and the other male, striking the victim in the neck. The gunfire also impacted an occupied home and a parked car in the driveway.
While emergency crews attempted life-saving measures on the 23-year-old man, two boys, later identified as members of the same gang, drove up and surrendered to authorities. Inside their vehicle, investigators discovered a handgun, which was later determined to be stolen from a car in Lehi, as well as gang paraphernalia.
The police apprehended the two boys who surrendered, along with a third boy who had earlier been involved in the altercation. All three were taken to a youth detention center while the investigation continued.
Through interviews, the detained suspects identified a fourth person linked to the crime: Leopoldo Gutierrez, a 25-year-old relative of one of the juveniles involved.
