Gun Rights Groups Sue to Dismantle Key Parts of National Firearms Act
NRA and allies file lawsuit challenging constitutionality of NFA after tax repeal

The lawsuit comes in the wake of the One Big Beautiful Bill Act, recently signed into law by President Trump, which eliminated the $200 tax previously imposed on suppressors, short-barreled rifles, and other items regulated by the NFA. The plaintiffs argue that the NFA's regulatory framework, which includes registration requirements and long application delays, was originally justified as a tax enforcement measure. With the tax now repealed, they contend that the remaining regulations have no constitutional basis and impose an impermissible burden on the Second Amendment. The lawsuit cites historical precedent, including the Supreme Courts ruling in Sonzinsky v. United States and the more recent Bruen decision, to argue that these itemssuch as suppressorsare neither dangerous nor unusual and thus are protected arms. The suit names the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Department of Justice (DOJ) as defendants and seeks to block enforcement of NFA provisions related to the making, transferring, or possessing of affected firearms and accessories. Plaintiffs include two individual gun owners as well as a Missouri firearms retailer. Legal observers suggest the case could take years and ultimately reach the U.S. Supreme Court. Still, gun rights advocates view this as a historic opportunity to roll back nearly a century of federal gun control.
