Donna Smith, who was charged with the fatal shooting of Jeffrey Simmons, has been granted immunity from prosecution in a landmark ruling based on self-defense. A Florida judge ruled that the prosecution had failed to disprove Smiths argument that she acted in self-defense when she shot Simmons in her office. Smith, a real estate agent, claimed that she fired in defense of her own life after Simmons became aggressive with her. The incident took place at a Vero Beach real estate office in February 2024. After a two-day hearing, the judge invoked Florida's 'Stand Your Ground' law, which allows individuals to use deadly force if they believe their lives are in imminent danger. The prosecution had argued that Smith's actions were not justified, as Simmons was unarmed. However, the judge found that the evidence presented by Smith including witness testimonies, video footage, and her own testimony was sufficient to substantiate her claim of self-defense. As a result, the judge dismissed all charges, including second-degree murder.
