The Supreme Court has announced its decision to hear a significant gun rights case concerning Hawaii’s strict regulations on where firearms can be carried. This development comes in response to a request from the Trump administration, which argues that Hawaii’s law violates a 2022 Supreme Court ruling affirming the Second Amendment’s provision for the general right of individuals to carry firearms.
The law in question prohibits guns on private property—such as stores and hotels—unless the property owner explicitly allows them through verbal consent or signage. According to Hawaii’s Solicitor General D. John Sauer, the default rule essentially acts as a near-complete ban on the public’s ability to carry firearms on private property, given that most property owners do not display signs either permitting or prohibiting firearms.
The case will not address Hawaii’s broader restrictions on firearms in other areas—including beaches, parks, and restaurants that serve alcohol. If the plaintiffs prevail, businesses would retain the option to impose restrictions on firearms on their premises. Attorney Alan Alexander Beck, representing the challengers, highlighted the historical right of businesses to indicate their preferences regarding firearms with signage.
Hawaii contends that it has already modified its concealed-carry permit regulations to comply with the Supreme Court’s 2022 ruling and argues that its current law represents a reasonable balance between ensuring gun rights and maintaining public safety.
A judicial challenge to Hawaii’s law initially resulted in a ruling that blocked its enforcement following objections from a gun rights group and three individuals from Maui. However, the 9th U.S. Circuit Court of Appeals intervened, largely reversing that decision and allowing the law to be enforced.
Gun-safety advocates, such as the group Everytown, are urging the Supreme Court to uphold Hawaii’s regulations. Janet Carter, managing director of Second Amendment litigation for the organization, reinforced the position that the 9th Circuit rightly deemed it constitutional to restrict firearms on private property unless property owners choose to allow them.
Currently, there are four other states with laws prohibiting firearms in designated sensitive locations, but similar restrictions on private property have faced opposition elsewhere, notably in New York. The Supreme Court has previously declined requests from gun-rights groups to completely invalidate New York’s regulations.
The conservative-majority court’s 2022 ruling concerning gun rights has set a new precedent, indicating that contemporary gun regulations must align with historical practices. Since that ruling, the court has ruled against a ban on bump stocks implemented during Trump’s presidency, while also upholding a ban on ghost guns under President Biden’s administration. Additionally, the court has supported legislation designed to protect victims of domestic violence.
As the Supreme Court prepares to review this case, the implications for gun owners and rights advocates are considerable. A favorable ruling for the challengers could empower gun owners in America, as it would reinforce the notion that individuals have the right to carry firearms even on private property, provided they adhere to property owners' regulations. On the other hand, a ruling siding with Hawaii could solidify existing restrictions on firearm carry laws in sensitive locations, setting a precedent that could affect similar laws across the country.
